Privacy policy for the "Spots" app

I attach great importance to data protection. Your personal data is collected and processed in compliance with the applicable data protection regulations, in particular the Basic Data Protection Ordinance (DS-GVO).

The following data protection declaration applies to the use of the "Spots" app.

I only use personal data if this is necessary for the proper provision of the services of this app.

3. Which data do I use why?

3.1 Information retrieval from my server:

If information (e.g. photos of "spots") is retrieved from my server when using the app, the following data is transferred:

- Date and time of retrieval
- Time zone difference to Greenwich Mean Time (GMT)
- Name of the retrieved file (URL)
- Status information (e.g. error messages)
- transferred data volume
- IP address of the user
- Type and operating system version of the device
- Version of the "Spots"-app

No personal data is stored when information is retrieved from my server.

The legal basis for the collection of the above-mentioned data is Art. 6 para. 1 lit. f DS-GVO, because this processing is necessary to protect my legitimate interests. I am pursuing legitimate interests,

- correctly deliver and optimize the contents of the app,
- ensure network and information security, and
- protect them from attack, interference and damage.

3.2 Location data:

You can allow access to your location data when using the app. These are collected and stored when a "spot" is created to enable other users to find the "spot" on the map. Location data is transmitted via an encrypted connection.

I do not use the location data to create a movement profile of you.

Map material is integrated on iOS devices via Apple Maps, a service of Apple Inc. (One Apple Park Way, Cupertino, CA 95014, USA). The transmission of location data to Apple Inc. is exclusively anonymous. For more information about Apple's data processing, please visit: https://www.apple.com/de/privacy/.

The legal basis for the processing of your data after your consent is Art. 6 para. 1 lit. a DS-GVO. You can deactivate the access of the app to your location at any time in the corresponding settings of your mobile device and thereby revoke your consent.

3.3 Access to device camera / photo gallery:

You can allow access to your device camera and photo gallery while using the app. This makes it possible to upload a photo when creating a "spot" in order to give other users a visual impression of the situation.

The legal basis for the processing of your data after your consent is Art. 6 para. 1 lit. a DS-GVO. You can deactivate the access of the app to your camera and photo gallery at any time in the corresponding settings of your mobile device and thereby revoke your consent.

4. Earmarking, storage duration, data minimization:

I commit myself to the principles of proportionate and purpose-bound data processing as well as data minimization. Personal data will only be used for the stated purposes. Unless specifically stated, I will only store personal data for as long as is necessary to fulfil the purposes pursued.

5. your rights as a data subject:

As a person affected by data processing, you have the following rights:

- Right of access to the personal data concerned (Art. 15 DS-GVO): 
- Right to correction (Article 16 DS-GVO).
- Right to cancellation (Art. 17 DS-GVO).
- Right to limitation of processing (Art. 18 DS-GVO).
- Right of objection against the processing if the data processing is based on Art. 6 para. 1 letter e or letter f DS GMO (Art. 21 DS GMO); see also the reference to the right of objection under Art. 21 DS GMO in point III.
- Right to data transferability (Art. 20 DS-GVO).
- right to withdraw consent at any time without prejudice to the legality of the processing carried out on the basis of the consent until withdrawal if the processing is based on consent pursuant to Article 6(1)(a) or Article 9(2)(a) DS-GVO. 
- Right of appeal to a supervisory authority (Art. 77 DS-GVO). 6 Data security:

I am committed to the security of your data within the framework of the applicable data protection laws and technical possibilities.

All personal data is transmitted in encrypted form when using the app. I use the SSL (Secure Socket Layer) coding system.

I also take technical and organisational measures in accordance with the requirements of Art. 32 DSGVO for the protection of the user's personal data.
